Extremity Medical Prevails in Patent Challenge, Strengthening Protection for Intraosseous Fixation System

Extremity Medical, a global leader in medical devices for upper and lower extremities, has successfully defended its U.S. Patent No. 11,298,166 for the innovative Intraosseous Fixation (IO FiX) bone fixation system.
The patent survived a challenge from Fusion Orthopedics at the U.S. Patent Trial and Appeal Board (PTAB).
The dispute arose when Fusion began selling its IntraLock Bone Fixation System, claiming it did not infringe upon the ‘166 Patent.
Extremity Medical responded by filing a lawsuit in the U.S. District Court for the District of Arizona, seeking to stop the alleged infringement. In turn, Fusion filed a petition for inter partes review (IPR) at the PTAB, questioning the patent’s validity.
On November 4th, 2024, the PTAB issued a Final Written Decision, ruling that Claim 11 of the ‘166 Patent is valid and patentable over the prior art cited by Fusion. The PTAB determined that Fusion failed to show why a person of ordinary skill in the field would have been motivated to combine the prior art to create the invention described in Claim 11. This key finding resulted in the dismissal of Fusion's challenge.
With the patent now upheld, the case is expected to return to the U.S. District Court in Arizona, where a decision on the alleged infringement by Fusion will be made.
